Listed Below are the five claimable Cab Conditions. As with all penalties, you must provide engine number, time penalty occurred, and company officer who approved it. It is also in your best interest to VTR the defect as this will provide a paper trail for payroll to track, and help validate your claim, as well as ensure the defect has at least a chance to be repaired.
1. Cool Portable Water – This requirement only pertains to having cool drinking water, and does not mandate that lunches, sandwiches, etc. are to be kept from getting soggy or warm. The claimant must state what is wrong with the mechanical refrigerator, the agreement does not support missing shelves or a burned-out light, for example. This claim is payable to the whole crew.
2. Conductor Desk – New comfort cabs have built in desks and do not require anything further in terms of writing surfaces. Most of the older, non-comfort cab former BN locomotives have a folding desk that needs to be in working order. This claim is payable only to a conductor.
3. Conductor Light – Map lights or other directional lights (dome light with shade to only distribute light on one half of the locomotive cab) are required on BN units. On former BN territories, this is payable to all ground crew members. This Claim is only payable to conductors.
4. Cab Seals – Windows and Doors to Provide Adequate Protection against Weather Conditions. Employees need to state what the problem is and where it exists on the window or door seals, e. g., leading conductor side-window blowing cold air, causing an uncomfortable, cold work environment in the locomotive. The employees must support what conditions existed to affect the cab, what caused the drop in temperature, was cold air, rain, snow etc. penetrating the cab due to faulty cab seals on the door or window? The minimum temperature requirement inside the cab of a locomotive to avoid a CC claim is 50 degrees Fahrenheit 6 inches above the seat. There is no maximum temperature. Unlike the other locomotive cab violations, weather-stripping claims do not necessarily need to be reported prior to departure from the initial terminal, due to potential need to achieve track speed to note flaws. When crews claim BO weather-stripping they must include: 1) what the weather was, 2) what adverse condition happened inside the cab because of the missing weather-stripping and 3) specific location of defective weather-stripping. No payment is due for water seeping through door or dripping on floor. Claims due to leaking must include details of how/where the claimant became wet. No payment is due for noise, fumes or dust coming into the cab through the door or window. If cold air is coming into the cab through the door or window, the cab heater should be used. If cab heaters were not working or sufficient, this should be specified and the information must adequately support a cab temperature below 50 degrees F 6 inches above the seat. (This then also becomes an FRA Defect) This claim is payable to the whole crew.
5. Toilet (Sanitary Toilets) – The claimant must state what is wrong with the toilet, won’t flush, overflowing, etc. (B/O Toilet is not payable.) No payment is due based upon odor. The claimant must specify what made the toilet unsanitary/filthy. This claim is payable to the whole crew.
